RE: OAK HARBOR MEMORANDUM

On Sunday, May 23, 2010, Oak Harbor responded to the Union's proposal that was given to the Company on Thursday, April 15, 2010. The Company has indicated that they are unwilling to enter into a new agreement that includes either the Western Conference of Teamsters Pension Plan or the Washington Teamsters Retirees Welfare Trust.

Based on these serious issues, it is unlikely that any contract settlement can be achieved prior to the National Labor Relations Board trial which is set to begin Monday, June 28, 2010.

While disappointed with the Company's position, we will push forward with the National Labor Relations Board and will also be ready to return to the bargaining table when appropriate.
